1. Introduction

EverLearns is an AI-enhanced learning space where you can learn with any material just like you would with a tutor.

By using any of EverLearns products, you confirm your acceptance of, and agree to be bound by, these terms and conditions.

2. Agreement to Terms and Conditions

This Agreement takes effect on the date on which you first use any of EverLearns products.

3. Software License Options

3.1 Lifetime License

The Lifetime License allows users to purchase individual EverLearns products, providing unrestricted and perpetual access to their comprehensive functionalities. This license is a one-time purchase with no recurring fees or subscriptions. However, please note that the licensor retains the right to terminate the license without conditions or prerequisites. This termination provision allows the licensor to exercise control over software distribution and utilization. Opting for the Lifetime License enables users to enjoy the benefits of the software while recognizing the licensor's unrestricted termination rights.

3.2 Subscription License

In addition to the Lifetime License, we offer a Subscription License, where users can subscribe to and pay monthly for the usage of EverLearns products. The Subscription License offers flexibility and ensures continuous access to the products as long as the subscription is active.

Please note that each license, whether Lifetime or Subscription, applies to one product at a time. Purchasing a license for one product does not grant access to other products.

4. Refund Policy

Due to the nature of our products, EverLearns does not offer a refund policy. All sales of our software licenses are considered final. We encourage users to thoroughly evaluate our products before making a purchase.

5. Disclaimer

We do not warrant that EverLearns products will meet all your requirements or that their operation will be uninterrupted or error-free. All express and implied warranties or conditions not stated in this Agreement, including but not limited to loss of profits, loss or corruption of data, business interruption, or loss of contracts, are excluded and expressly disclaimed to the extent permitted under applicable law. This Agreement does not affect your statutory rights.

6. Warranties and Limitation of Liability

6.1 Quality and Fitness

EverLearns does not provide any warranty, guarantee, or other term as to the quality, fitness for purpose, or otherwise of the software.

6.2 Limitation of Liability

EverLearns shall not be liable for any indirect, special, or consequential loss, damage, costs, expenses, or other claims (whether caused by EverLearns's negligence or the negligence of its servants or agents or otherwise) that arise out of or in connection with the provision of any goods or services by EverLearns. We shall not be liable or deemed to be in breach of contract due to any delay in performing or failure to perform our obligations caused by any event beyond our reasonable control. In the event that EverLearns is found liable for breach of this Agreement, our liability is limited to the amount actually paid by you for the services or software.

6.3 Release from Claims

You hereby release EverLearns from any and all obligations, liabilities, and claims in excess of this limitation.

7. Responsibilities

EverLearns is not responsible for how users handle any user-generated content.

8. General Terms and Law

This Agreement is governed by the laws of Vietnam. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and EverLearns as a result of your use of these services. You agree not to hold yourself out as a representative, agent, or employee of EverLearns. You also agree that EverLearns will not be liable by reason of any representation, act, or omission to act by you.
